Mage Labs Protocol

This Privacy Policy ("Policy") explains how Mage Labs Protocol ("Mage Labs," "we," "our," or "us") collects, uses, shares, and protects information when you access or use our decentralized web interface (the "Interface") to interact with the permissionless smart contracts comprising the Mage Labs Protocol on the Solana blockchain.

We are committed to ensuring compliance with applicable U.S. laws, California's CCPA/CPRA, and the European Union's Markets in Crypto-Assets Regulation (MiCA) and General Data Protection Regulation (GDPR) where relevant.

1. Who We Are

Mage Labs is not presently authorised as a crypto-asset service provider (CASP) under Regulation (EU) 2023/1114 (MiCA) nor registered as a money services business (MSB) under 31 CFR Chapter X. This assessment is based on our understanding that we neither (i) provide custody nor (ii) accept and transmit digital assets on behalf of others. We continually monitor regulatory developments and will update this disclosure if our status changes or further guidance is issued.

2. Data We May Collect

Although we strive to minimize data collection, using the Interface may result in the collection of:

a. Automatically Collected Data

  • Public blockchain wallet address (when you connect your wallet)
  • Device information (e.g., browser type, OS, screen size)
  • IP address (to prevent abuse or comply with legal obligations)
  • Interaction data (e.g., which features are used)
  • Cookies (used only for functional or anonymized analytics)

⚠️ We do not collect names, emails, phone numbers, private keys, or financial data.

b. Optional User Communications

If you voluntarily contact us (e.g., via X, Telegram, or email), we may collect and retain your message and associated contact info.

3. Why We Process Data

In compliance with MiCA Article 62(1)(e) and U.S. consumer protection standards, we process minimal technical data for these purposes:

  • Security and fraud prevention
  • Compliance with applicable laws or regulatory inquiries
  • Functionality and performance optimization
  • De-identified analytics to improve UX

We do not use your data for behavioral advertising, user profiling, or resale to third parties.

4. Legal Bases for Processing (EU & MiCA Compliance)

Under the GDPR and MiCA, our processing of technical data is based on:

  • Legitimate interests (e.g., security, abuse prevention)
  • Legal obligation (when required to comply with law enforcement or regulators)
  • User consent (for non-essential cookies or voluntary communications)

5. Data Sharing and Disclosure

We do not sell or rent user data. We may share information only with:

  • Service providers (e.g., hosting or analytics tools, under data processing agreements)
  • Regulators or authorities when legally compelled
  • Open-source collaborators for bug tracking or feature requests (only anonymized or user-submitted info)

8. Data Security

We implement industry-standard safeguards to protect technical data. However, no system is 100% secure. Users are responsible for securing their wallet credentials and exercising caution when interacting with on-chain assets.

9. Data Retention

We only retain minimal data for as long as needed to:

  • Fulfill the purpose for which it was collected
  • Comply with legal or regulatory requirements
  • Support platform debugging or abuse monitoring

Public blockchain data (e.g., wallet activity) is stored immutably and cannot be deleted by us.

10. Cross-Border Transfers

Our services are global and decentralized. Data may be processed in jurisdictions that do not provide the same level of protection as your country. We apply appropriate safeguards (e.g., Standard Contractual Clauses for EU users) where applicable.

11. Children's Data

This Interface is not intended for use by individuals under the age of 18. We do not knowingly collect or solicit data from minors.

12. Changes to This Policy

We may revise this Privacy Policy to reflect changes in law or project governance. Updates will be posted to this page with the "Effective Date" revised. We encourage you to review the Policy periodically.

14. Additional Disclosures for U.S. Residents (California/CCPA)

  • The right to limit the use of sensitive personal data (Note: We do not collect this)
